In this statement, Spectral Enterprise B.V., established in (1033 RX) Amsterdam at Plotterstraat 22, registered with the Chamber of Commerce under number: 65812573 (hereinafter “Spectral”), explains which personal data Spectral collects and processes, for what purposes this data is processed and what its cookie policy is.

Our privacy policy

Personal data is processed by Spectral in various ways. In all cases, Spectral respects your privacy and treats your personal data carefully and confidentially. By processing we mean all the use of your personal data, such as storing, adjusting, forwarding or (partially) deleting this data. The processing of your personal data is done per the General Data Protection Regulation (GDPR).

Personal data that we process

Spectral processes your personal data because you use our services and/or because you provide it to us yourself.

Below you will find an overview of the personal data we process:

  • First and last name
  • Phone number
  • E-mail address
  • Your IP address
  • Information about your activities on our website
  • Internet browser and device type
  • Household energy consumption 
  • Other personal data that you actively provide, for example by creating a profile on this website, in correspondence, and by telephone.

Spectral does not employ automated decision making that relates to natural persons (GDPR Article 4.4).

For what purpose and on what basis do we process personal data

Spectral processes your personal data for the following purposes and on the mentioned lawful bases (GDPR Article 6):

Contractual: the processing is necessary for a contract Spectral has with you, or because you have asked us to take specific steps before entering into a contract.

  • To deliver goods and services to you
  • To inform you about changes to our services and products
  • Handling your payment
  • To be able to call or e-mail you if this is necessary to carry out our service

Consent: you have given Spectral clear consent to process your personal data for a specific purpose.

  • To offer you the opportunity to create an account
  • To analyse your behaviour on the website in order to improve the website and tailor the range of products and services to your preferences
  • Track your surfing behaviour across various websites with which we tailor our products and services to your needs

Legal obligation: the processing is necessary for Spectral to comply with the law (not including contractual obligations).

  • Processes personal data such as data that we need for our tax return

Retention periods

Spectral does not store your personal data for longer than is strictly necessary to achieve the purposes for which your data is collected. The data you have provided to us so that we can contact you will be kept until the contact has taken place. Furthermore, data will be kept as long as you are a customer or a relation of ours. After that, we store data for a maximum of 24 months after the last delivery, with the exception of invoices. We keep it for 7 years in connection with our legal obligations.

How we secure personal data

Spectral takes the protection of your data seriously and takes appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure, and unauthorized modification. Provision to third parties

Spectral does not sell your data to third parties and only provides it if this is necessary for the execution of our agreement with you or to comply with a legal obligation. We conclude a processing agreement with companies that process your data on our behalf to ensure the same level of security and confidentiality of your data. Spectral remains responsible for these processing operations.

View, modify, or delete your data

You have the right to view, correct, or delete your personal data. In addition, you have the right to withdraw your consent to the data processing or to object to the processing of your personal data by Spectral and you have the right to data portability. This means that you can submit a request to us to send the personal data we hold about you in a computer file to you or another organization mentioned by you.

You can send a request for access, correction, deletion, data transfer of your personal data, or request for withdrawal of your consent or objection to the processing of your personal data to privacy@spectral.energy.

To ensure that the request for inspection has been made by you, we ask you to enclose a copy of your proof of identity with the request. Make your passport photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number, and citizen service number (BSN) black in this copy. This is to protect your privacy. We will respond to your request as quickly as possible, but in any case within four weeks.

Amendments

The rules regarding the protection of personal data can change constantly. We therefore reserve the right to make changes to this privacy statement. Please check this statement regularly.
